If a person is captured by Immigration and Customs Enforcement (ICE) crossing the border or are found to be living in the United States illegally, they can wind up in the IAH Secure Detention Facility while they wait to go before the Houston Immigration Court.

Priority on Removal

The passage of bill SB4 in the Texas Senate and eventual enforcement has made the detention and removal of illegal immigrants a priority for local and federal law enforcement officers since its inception in 2017. The substantial increase in captures and detention has also led to an influx of people waiting to see an immigration judge. The wait can last months and usually ends in the deportation of any person who has been caught trying to enter the country through the southern border or living illegally in the United States.

The reasons a person may face removal proceedings include:

  • They have entered the United States without authorization.
  • They have stayed in the United States after their visa has expired.
  • They have violated the terms of their visas
  • They have been convicted of a crime or multiple crimes

Once a person has been flagged for deportation by U.S. ICE agents, they are sent to a detention facility where they await an immigration judge to hear their case. Only 35 percent of all the people who go in front of an immigration court has paid legal representation, 2 percent use a pro-bono lawyer and 63 percent have no representation at all.
