What is Intoxication Manslaughter?
Intoxication manslaughter is the name given to the crime in which an intoxicated person is operating a vehicle, aircraft, watercraft, or amusement ride, or assembling of a mobile amusement ride results in the accidental death of another person.
However, there’s a difference between voluntary Intoxication and involuntary Intoxication that can be taken into account during a trial. Voluntary manslaughter means that the persona voluntarily got drunk and then caused the death, versus involuntary means the person did not get drunk on purpose and then caused the accident. Although there is a fine line between the two, one example is if someone slipped something into that person’s drink, and therefore that person became intoxicated, leading to driving and causing the death.
Intoxication Manslaughter Penalties
As stated by Section § 49.08 of the Texas Penal Code, the following penalties for intoxication manslaughter are the following:
Offense: Second Degree Felony
Fine: Up to $10,000
Incarceration: 2 to 20 years
However, as stated by section § 49.09 of the penal code, the penalties for code § 49.08 can move up to a first-degree felony if the person caused the death of a firefighter or emergency service staff while they were on duty additionally if they caused the death of a peace officer or judge while they were on duty. There can also be a mandatory community service sentence in addition to the fines and incarceration. The mandatory hours start from 240 hours to 800 hours.
