Why Do I Need a Texas Social Security Lawyer?
Once you file your claim, you should receive a letter from Social Security regarding their decision on your claim. If you received an unsatisfactory decision, you have a right to appeal your claim, however, you should not do so without the services of a knowledgeable Texas Social Security lawyer.
Appealing a Social Security Claim
If you do not approve of Social Security’s decision regarding your claim, you and your attorney may appeal that decision. In this phase, Social Security will reexamine your case, including evidence that was initially submitted, as well as any new evidence submitted, and if you can prove that they made the wrong decision, they will reverse their decision and award you the benefits you deserve. That being said, you must submit your appeal in writing and within 60 days of receiving the denial letter.
Social Security Hearings
If Social Security’s reconsideration did not work in your favor, you may request a hearing, wherein an administrative law judge will determine whether you qualify for Social Security benefits. In many cases, at this point. it can be beneficial to submit additional evidence to prove your case. The administrative law judge will question you, and additional witnesses, such as doctors, regarding why you believe you qualify for benefits. You and your attorney are also permitted to question any witnesses you bring to the hearing. Once the hearing concludes, you will receive a letter regarding the judge’s determination on whether you qualify for Social Security benefits.
What is the Appeals Council?
If, by some chance, your hearing still does not produce favorable results on your behalf, you and your attorney may request a review by the Social Security’s Appeals Council. While this is a viable option in many cases, you should also understand that the Appeals Council has the legal right to deny your request to review the verdict if they believe the verdict was correct. The Appeals Council will either examine your case on its own or send it back to an administrative law judge. You will receive a letter regarding the outcome of the Appeals Council’s or the administrative judge’s final decision at this time.
Taking Your Social Security Case to Federal Court
If you are denied benefits once again, your last option is filing a lawsuit in a federal district court.
