Robbery or burglary charges are different but serious

Most people use the words theft, burglary and robbery interchangeably. In the legal world, theft encompasses many crimes, such as shoplifting, burglary, robbery and petty theft. Although the distinctions are often small, the consequences for one of these crimes can be life-changing, even for first offenders.

In Texas Penal Code § 29.02, robbery is when a person commits theft and causes bodily injury to another or threatens to use force to deprive someone of the property. Generally, robbery is a felony of the second degree, although some circumstances can make it a felony of the first degree. Injuring a senior citizen or a disabled person makes the crime aggravated robbery.

Will marijuana penalties in Texas be reduced?

Laws regarding marijuana have been changing rapidly in many states over the past few years. Not only have several states reduced penalties for small offenses and legalized medical use, but some have completely permitted recreational use. However, if you are a proponent of marijuana legalization in Texas, you are likely disappointed by the strict laws and reluctance to change.

But the tides might be shifting. House Bill 81, legislation that seeks to eliminate the threat of arrests and incarceration for possessing one ounce or less of the drug, was introduced on March 13th, 2017. How does this contrast with current state laws? Here is an overview of how tough Texas is on marijuana possession and what might change.

Answering the Call to Help

When the results came in that late November night that our country's next President would be President Trump, it left many in shock, some happy, some in total bewilderment, and others in complete panic. Here at The Gonzalez Law Group, our motto to be "Your legal team for life" isn't just a catchy phrase; it's a promise to be there for the most frustrating, confusing, and scariest moments in your life. And for many, a new administration that ran their campaign on anti-immigrant rhetoric was their worst nightmare come alive.

The topic of Immigration and the changes the new administration promises to bring with it has remained a prevalent topic of conversation for many in the Latino community. There are many questions, but not many safe places to go to get answers. With over 70 families coming in to ask a variety of Immigration-related questions on the morning of March 4, lawyers from the Gonzalez Law Group, along with other local lawyers, answered that call by volunteering to give free consultations to any who came through the doors of YES College Prep Southeast.

What you need to know about false and coerced confessions

It may seem absolutely incomprehensible why suspects would admit to a crime they did not commit, especially considering the lifelong consequences a conviction and prison sentence would have on their lives. However, false confessions are not a rare circumstance and have reasonable explanations for their occurrence. Understanding how a false confession happens can help you avoid admitting to a crime of which you are not guilty.

What is the definition of a false or coerced confession?

The most obvious form of these confessions is when a person makes a statement of guilt that is not true. However, they can also include authorities misinterpreting a statement as a confession or claiming the existence of a statement despite denials from the suspect.

Tips for dealing with insurance companies after a car accident

It is true that insurance companies do not always seem to hold up their end of the bargain. However, after you have been involved or injured in a car accident, there are a few things you can do to make the insurance process go more smoothly. This is true whether or not you believe the accident is your fault.

Avoid assigning blame

You may think the car accident is your fault. On the other hand, you may not, or you might see it as somewhere in between. Whatever the case is, hold off on making judgments when you speak to the police and to your insurance agent. You do not know where the other driver was, what he or she may have been drinking, and so on. Give facts such as where, when, what and who to the best of your ability, but do not misrepresent anything or give an answer you are not sure about.

Truck driver fatigue contributes to highway fatalities

Most truck drivers are good at their jobs and operate their vehicles responsibly. However, almost 4,000 people die as the result of large truck accidents each year, and the primary cause is driver fatigue. In an ongoing effort to improve highway safety, the Federal Motor Carrier Safety Administration (FMCSA) regulates the number of hours truck drivers spend behind the wheel.

How well do you know your Miranda Rights?

If you are arrested or stopped by the police, do you know what to do? Do you know what to say? Are you aware of your rights?

Most people are familiar with Miranda Rights to some degree. But in the heat of the moment - during an arrest or while being taken into police custody - how much does the average person remember?
